Immigration Law Update: Approaching H-1B Cap for 2014

Employers seeking H-1B temporary work visas for foreign nationals in “professional-level” positions can begin filing their petitions for visas on April 1, 2013, for employment beginning on October 1, 2013.

 

The demand for H-1B visas for the upcoming quota is anticipated to be higher than last year. Employers are advised to send the H-1B petitions on March 29, 2013 for delivery on April 1, 2013. Last year the cap was reached in June and we do not know how quickly it will be reached this year.

In President Obama's State of the Union Address last Tuesday, it was clear Immigration Reform will be on the top of his agenda for the year. We urge you to contact your Senators and Representatives to decrease the backlogs for persons waiting to obtain residency. We also urge you to share with your elected officials the need to reform the process of bringing skilled workers into the United States.
