Sean C. Kirk helps businesses resolve disputes and maximize the return on their dealings with other individuals and companies. He concentrates his practice on commercial and general business litigation, secured transactions and creditors’ rights matters. He also represents clients in a variety of litigation matters arising in state, federal or bankruptcy court. Sean’s broad range of clients include institutional lenders and financiers, real estate and equipment lessors and electronic payment processing companies involved in a variety of industries.

Sean defends his clients against preference and avoidance actions and is actively involved with representing his creditor clients’ rights in bankruptcy proceedings across the United States. He also represents his clients in all facets of bankruptcy litigation, including “first day” motions, critical vendor motions, stay relief motions, 363 sales, discharge and dischargeability actions, the assumption/rejection of contracts and litigation related to confirmation of a debtor’s proposed plan of reorganization.

Sean also manages multi-jurisdictional litigation on behalf of his clients across the United States. A significant portion of his practice also involves commercial loan workouts and representation of secured lenders in commercial foreclosure and deficiency actions.

Sean resides in Nashville with his wife, Candice. He is an active participant in his community, whether checking out a concert, supporting local businesses or charities, or using his useless music trivia knowledge for a good cause. He also enjoys traveling, reading, and watching sports, especially the Georgia Bulldogs and Atlanta Braves.
