Staying the Enforcement of a Foreign Court Judgment on the Sale of Real Estate Worth Half a Million Euros | LEADELL Deals and Cases

LEADELL Vītols team of experts has defended the interests of a Latvian company in a dispute with a Belgian undertaking, obtaining a decision to stay the enforcement of ajudgment certified as European Enforcement Order (EEO). As part of the execution of this judgment, a sworn bailiff in Latvia had already proceeded with auctions of the real estate of this company. The Belgian court had gravely infringed the client’s right to a fair trial when issuing the EEO.

Legal assistance for the client was organized simultaneously in both Latvia and Belgium. Based on the evidence and arguments gathered by the LEADELL Vītols dispute resolution team of experts, the Latvian court upheld the application for stay of enforcement of the judgment until the Belgian Court of Appeal has ruled on this matter. Besides that, in light of continuous defense of the client’s interests, LEADELL Vītols provided the necessary support to attorneys in Belgium to obtain the stay of the enforceability of the issued court judgment, which would further prevent the enforcement of the said EEO in Latvia.

For this reason, after successfully safeguarding the client’s interests, properties worth almost half a million euros, which are vital for the company’s operation and business, were protected from being sold.
